Recent Developments in legal developments

The National Assembly and the Ministry of Justice have set up a National Steering Committee on development of the anti-GBV law in Lao PDR following a national conference held by the National Assembly in Nov 2010. From November 2011 to April 2012, a Legislative Review towards a Comprehensive Anti-GBV Legislation in Lao PDR was carried out with support of UN Women The purpose of the legislative review is to support and assist the National Assembly/Lao government in reviewing the current legislative provisions in Lao PDR regarding gender-based violence prevention and response, with focus on violence against women and girls; and to identify gaps, potential areas of conflicts with international human rights treaties and propose areas for legal improvement, and make recommendations for a comprehensive legislation.

Two days Expert Group Meeting

In order to contribute to a full understanding of the recommendations of the legislative review and to assist the Lao Government in its future work towards developing a comprehensive anti GBV legislation, the Lao Ministry of Justice intends to convene a two days Regional Expert Group Meeting (EGM) legislation on gender-based violence in collaboration with the National Assembly, Lao NCAW and LWU, with support of UN Women.

The EGM will explore a range of regional and international good practices in the area of law development on gender based violence and will focus on the following critical areas:

  • Conceptual framework of a comprehensive legislation
  • Human rights based approach
  • Critical definitions, scope and coverage of relationships 

The objectives of the EGM are to:

  • Share good international practices in the anti GBV legislation and exchange views among Lao and international experts
  • Analyze different approaches in the law for addressing forms of GBV, with particular attention to experiences in legal systems similar to Lao PDR’s, and the scope of such legislation;
  • Assess lessons learned in the implementation of legislation on GBV with particular attention to effectiveness of legislation
  • Recommend an appropriate Framework and Standards for legislation on GBV, with particular attention to the forms of GBV prevalent in Lao PDR
  • Recommend on the Lao Strategy and Action Plan for drafting the anti GBV law

Expected Outcome:

  • Increased regional exchange on good practice anti-GBV legislation and drafting process
  • Recommended Guidance for drafting anti GBV law in Lao PDR
  • A Recommended Framework for legislation on GBV in Lao PDR

The guidance and a framework are expected to assist Lao PDR in enhancing existing, and developing new legislation on GBV.
